Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Sunwing Airlines Inc., 27 Fasken Drive, Etobicoke, Ontario, M9W 1K6, as well as the pilots working for hire or reward for Sunwing Airlines Inc. identified in this exemption, operating under Part VII of the Canadian Aviation Regulations (CARs) from clause 725.124(28A)(b)(ii)(E), subparagraphs 725.124(33)(a)(i),(ii) and (iii), 725.124(33)(e)(i), (ii), clause 725.124(33)(e)(iii)(A), and subclauses 725.124(33)(e)(iv)(C)(I) and (II) of the Commercial Air Services Standards (CASS) made pursuant to paragraph 705.124(1)(b) of the Canadian Aviation Regulations (CARs), subject to the conditions of this exemption.
The requirements of the above mentioned provisions are detailed in Appendix A to this exemption.
Purpose
The purpose of this exemption is to allow three pilots working for hire or reward for Sunwing Airlines Inc. to be exempted from following the transition line indoctrination prior to conducting, as training pilots, the line indoctrination training program on Sunwing Airlines Inc. Boeing 737-800 aircraft.
Application
This exemption applies to Sunwing Airlines Inc. and the three pilots identified below while working for hire or reward for Sunwing Airlines Inc., for the purpose of conducting, as training pilots, the line indoctrination training program on Boeing 737-800 aircraft without first having followed the transition line indoctrination:
- Robert Latter, Licence Number AA350102
- Marty Neely, Licence Number AA200680
- Blair McRobb, Licence Number AA296839
Conditions
This exemption is subject to the following conditions:

Prior to their first flight with Sunwing Airlines, Robert Latter, Marty Neely and Blair McRobb shall:
- Complete the Sunwing Airlines Inc. initial training approved by Transport Canada in accordance with subsection 725.124(28A) of the CASS for a pilot qualified on type;
- Complete the Sunwing Airlines Inc. Flight Operations Company Indoctrination Training; and
- Successfully pass a PPC on type;
- Robert Latter, Marty Neely and Blair McRobb shall successfully pass a line check conducted by Transport Canada prior to conducting any line indoctrination training for Sunwing Airlines Inc; and
- A copy of this exemption shall be placed and remain on the training file of Robert Latter, Marty Neely and Blair McRobb prior to the commencement of the first flight at Sunwing Airlines Inc.
Validity
This exemption is in effect until the earliest of the following:
- January 31, 2006 at 23:59 EST;
- the date on which each of the exempted pilots meet all of the requirements of the provisions from which they are being exempted;
- the date on which any of the conditions set out in this exemption is breached; or
- the date on which this exemption is cancelled in writing by the Minister where he is of the opinion it is no longer in the public interest, or is likely to adversely affect aviation safety.
